Welcome to Prime Vision Media GroupBringing Life To Your Vision. These Terms & Conditions govern the relationship between Prime Vision Media Group ("we", "us", "our") and any individual or entity ("Client", "you") who accesses, engages with, or purchases services from us.

By booking, commissioning, or using any of our services — whether verbally, electronically, or in writing — you acknowledge that you have read, understood, and agree to be fully bound by these Terms & Conditions. If you do not agree, please refrain from engaging our services.

These terms are governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013 (POPIA).

Section 01

Our Services

Prime Vision Media Group provides a comprehensive suite of creative and digital services, including but not limited to:

  • Graphic Design — logo design, brand identity, marketing collateral, print and digital materials.
  • Media Production — photography, videography, content creation, motion graphics, and event coverage.
  • Software & Web Development — website design and development, landing pages, mobile applications, and SEO.
  • Marketing & Brand Strategy — social media management, digital marketing, brand advisory, and campaign strategy.

Service descriptions, deliverables, and timelines will be communicated in writing prior to commencement. Any scope changes must be agreed upon in writing and may affect pricing and timelines.

Section 02

Bookings & Payments

All service bookings must be confirmed in writing (via email or WhatsApp) before any work commences. Verbal agreements do not constitute a confirmed booking.

Advance Notice: All media service appointments must be scheduled a minimum of 48 hours in advance to allow for adequate preparation.

Payment Terms:

  • A non-refundable 50% deposit is required upfront before any work begins, unless otherwise agreed in writing.
  • The remaining balance is due upon completion and prior to final delivery of all files, assets, or live deployment.
  • Once-off packages are payable in full upfront unless a payment plan has been formally agreed upon.
  • All payments must be made via EFT (Electronic Funds Transfer) to our verified business account. Proof of payment must be submitted to confirm the transaction.
  • Prices are quoted in South African Rand (ZAR) and are exclusive of VAT unless otherwise stated.

Late payments may result in the suspension of services. Any outstanding invoices older than 30 days will incur a late payment fee of 5% per month on the outstanding balance.

Section 03

Cancellations & Rescheduling

  • Cancellations must be communicated in writing no less than 48 hours before the scheduled service date.
  • Cancellations made within 48 hours of the appointment will incur a cancellation fee of up to 50% of the quoted service value.
  • No-shows or same-day cancellations will be charged at 100% of the booking fee.
  • Deposits paid are non-refundable once work has commenced or resources have been allocated.
  • Rescheduling requests are accommodated once at no charge, subject to availability. Subsequent reschedules may incur an administrative fee.
In the event that Prime Vision Media Group cancels a booking due to unforeseen circumstances, all payments made will be fully refunded or the booking rescheduled at the Client's preference.
Section 04

Deliverables & Revisions

Deliverables will be clearly outlined in the project brief or proposal. Timelines are estimates and may vary based on scope, Client responsiveness, and complexity.

  • Each project includes a set number of revision rounds as agreed upfront. Additional revisions beyond this scope will be billed at our standard hourly rate.
  • Clients are required to provide feedback within 5 business days of receiving a draft. Delays in feedback may extend the overall project timeline.
  • Final files will be delivered in agreed formats upon receipt of full payment.
  • Source files (e.g. editable design files) may incur an additional cost unless explicitly included in the original quote.
Section 05

Intellectual Property

All creative work, designs, code, photography, videos, and other materials produced by Prime Vision Media Group remain the exclusive intellectual property of Prime Vision Media Group until full and final payment has been received.

  • Upon full payment, ownership of the final deliverables transfers to the Client for the agreed purpose and scope of use.
  • Prime Vision Media Group retains the right to display all completed work in its portfolio, social media, and marketing materials unless the Client requests confidentiality in writing.
  • The Client warrants that all content, images, text, or trademarks provided to us for use do not infringe on any third-party intellectual property rights.
  • Unauthorised reproduction, resale, or distribution of our work without written consent constitutes infringement and may result in legal action.
Section 06

Confidentiality

Both parties agree to maintain the confidentiality of any sensitive business information shared during the course of the engagement. This includes but is not limited to business strategies, financial data, client lists, and proprietary systems.

Confidential information will not be disclosed to any third party without prior written consent, except where required by law. This obligation survives the termination of the business relationship.

Section 07

Limitation of Liability

Prime Vision Media Group shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use of, or inability to use, our services — including loss of revenue, profit, data, or business opportunities.

  • Our total liability in respect of any claim shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
  • We are not liable for delays caused by force majeure events, including natural disasters, load shedding, connectivity disruptions, or other circumstances beyond our reasonable control.
  • The Client is responsible for backing up their own data and content. We are not liable for data loss resulting from third-party platforms or services.
Section 08

Client Conduct & Responsibilities

To ensure the smooth delivery of your project, the Client agrees to:

  • Provide all required content, assets, and information in a timely and accurate manner.
  • Maintain respectful and professional communication with our team at all times.
  • Not engage our team in the production of illegal, defamatory, harmful, or misleading content.
  • Review and approve project milestones within the agreed timeframe to avoid project delays.
Prime Vision Media Group reserves the right to terminate any project without refund if the Client engages in abusive behaviour, requests illegal content, or materially breaches these Terms.

Privacy & POPIA Compliance

Prime Vision Media Group is committed to protecting your personal information in accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA).

  • We collect only the personal information necessary to deliver our services and fulfil our contractual obligations.
  • Your information will not be sold, rented, or shared with third parties without your explicit consent, except where required by law.
  • You have the right to request access to, correction of, or deletion of your personal information held by us.

Section 10

Changes to These Terms

Prime Vision Media Group reserves the right to update, modify, or replace these Terms & Conditions at any time. Any changes will be effective immediately upon being posted on this page.

We encourage Clients to review these Terms periodically. Continued use of our services following any changes constitutes acceptance of the revised Terms. The most recent version will always be available on our website.
